Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Socialsmith (the "Service"), operated by Business Game Changer ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Socialsmith is a content generation tool that helps users create platform-specific social media posts and export them in CSV format. Socialsmith does not publish, schedule, or post content to any social media platform on your behalf — you remain responsible for reviewing, editing, and posting any content it generates.

2. Accounts

You must provide accurate information when creating an account and are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account.

3. Subscription and Billing

• The Service is offered on a subscription basis at $20 per month (or the then-current advertised price).
• Subscriptions renew automatically each billing period until cancelled.
• You may cancel at any time. Cancellation stops future renewals; your access continues until the end of the current paid period.
• All payments are non-refundable, including for partial billing periods, except where required by applicable law.
• We may change subscription pricing with reasonable advance notice. Continued use after a price change takes effect constitutes acceptance of the new price.

4. Acceptable Use

You agree not to use the Service to:

• Generate content that is unlawful, defamatory, infringing, or that violates the rights of any third party;
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its underlying systems;
• Use the Service to generate spam or mass-post misleading content at scale.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Content You Generate

You retain ownership of the input you provide and the output you generate using the Service, subject to the underlying rights of any third-party material you input (e.g. book excerpts you don't own the rights to). You are solely responsible for reviewing generated content before publishing it anywhere, including for accuracy and compliance with the policies of any platform you post to.

6. AI-Generated Content Disclaimer

Content is generated using third-party AI models. We do not guarantee the accuracy, originality, or fitness for any particular purpose of generated content. You are responsible for reviewing and editing all output before use.

7. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes to the Service at any time, and may suspend access where necessary.

8. Limitation of Liability

To the maximum extent permitted by law, Business Game Changer shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of business, data, or profits. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service if you breach these Terms. You may stop using the Service and cancel your subscription at any time as described in Section 3.

10. Changes to These Terms

We may update these Terms from time to time. We will make reasonable efforts to notify users of material changes. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles. Nothing in this section removes any mandatory consumer protection rights you have under the laws of the country in which you reside.
